1.1 The Landlord hereby lets to the Tenant, which hereby hires the Premises.

1.2 The Property is let voetstoots, and absolutely as it stands, with all its defects (if any), whether patent or latent.

1.3 The Tenant acknowledges that it has satisfied itself as to the nature, locality and extent of the Property.

1.4 The Landlord shall not be liable for any deficiency in the extent thereof.

4.1 The Tenant shall be entitled to cancel this lease in the event that the Landlord does or allows anything to be done which causes a substantial interference with the Tenant's use and enjoyment of the Premises.

4.2 The Tenant shall not be entitled to exercise the right to cancel as referred to in 4.1 above without first giving the Landlord two months (60 days) written notice calling upon the Landlord to cease or prevent the alleged interference and the Landlord failing to cease the interference.

4.3 Both the Tenant and the Landlord shall be entitled to give each other two (2) calendar months' notice. The two calendar months are considered as a penalty for early cancellation by the Tenant.

4.4 Should the Tenant fail to give two (2) calendar months' notice, the penalty payable will be two months' rental.

4.5 Cancellation / Handover

• On the final day of the tenancy, all keys must be handed over by 12:00 noon.
• Failure to return the keys on time will result in an additional day's rental being deducted from the Tenant's deposit.
• The property must be handed back in a clean and tidy condition.
• If the property is not returned in a clean state, a cleaning fee will be deducted from the Tenant's deposit.

5.1 The Tenant shall not be entitled to cede its rights or sub-let the Premises to any other person without the Landlord's written consent, which consent shall not be unreasonably withheld.

5.2 The Tenant shall not make any alterations or additions of any nature whatsoever to the Premises without the Landlord's written consent.

5.3 The Tenant shall use its best endeavours not to do or permit anything to be done in or on the Premises which is likely to cause a nuisance or annoyance to the neighbours and/or occupiers of neighbouring premises.

5.4 The Tenant shall at all times adhere to the complex/property rules submitted as Addendum "A" to this rental agreement. Failure to adhere to the rules will be regarded as a breach of this agreement and gives the Landlord the right to cancel this agreement with two calendar months' notice.

5.5 Electrical Tampering and Theft

The Tenant is strictly prohibited from tampering with, altering or bypassing any electrical installations, meters or wiring on the property.

Any act of electricity theft, including but not limited to illegal connections or meter bypassing, will be deemed a material breach of this lease agreement.

• The Landlord reserves the right to terminate the lease agreement with immediate effect.
• The Tenant will be liable for all costs of repair, replacement and reconnection.
• The Tenant's deposit may be forfeited to cover damages and expenses.
• The Landlord may pursue criminal charges under South African law, as electricity theft is a prosecutable offence.

6.1 The Tenant shall keep and maintain, at its own cost, the Premises and any plate glass, windows, garden, taps, drainage (including blocked drains), walls, ceilings, swimming pool and everything else on the Premises belonging to the Landlord, in the same order and condition as when delivered to the Tenant at the commencement of the lease, fair wear and tear excepted.

6.2 The Tenant shall at all times keep the Premises in a clean, tidy and sanitary condition.

6.3 The Landlord shall effect all structural repairs and shall, at its own expense, keep and maintain the structure of the building, including the roof structures, walls, floors (except floor coverings), common areas and structural installations in good order and condition.

6.4 The Landlord and/or Tenant shall commence and complete all repairs, maintenance and replacements that it is obliged to effect in terms hereof in a diligent and expeditious manner.

6.5 The Landlord shall ensure that all common areas and facilities in the building or on the land on which the building is situated are properly maintained and free of obstruction. The Tenant shall be entitled to access and the joint use of all common areas and facilities.

6.6 The Tenant will undertake to wash all windows, on the inside and outside, at least four times a year.

Should the Tenant discover that any of the appurtenances or Landlord's fixtures or fittings in or on the Premises, including keys, taps, fittings and other installations, are in a defective state or missing, the Tenant shall within 14 (fourteen) days from the commencement date of the lease notify the Landlord in writing of the details of any defect or missing item and, failing such notification, the Tenant shall be deemed to have received such appurtenances, fixtures or fittings in a good state of repair and condition.

8.1 The Landlord shall be entitled at any reasonable time to do repairs, renovations or decorations to the building of which the Premises form part and:

• To erect the building equipment required for the carrying out of that work.
• To erect such other equipment or device as may be required by law or which the Landlord's architect considers reasonably necessary for the protection of any person or property against injury arising out of that work.

8.2 The Landlord shall be entitled to such right of access to the Premises as is reasonably necessary for the carrying out of that work, provided that the Landlord:

• Shall not unnecessarily or unreasonably interfere with the Tenant's use of the Premises during the carrying out of that work.
• Shall carry out such work as expeditiously as possible in the circumstances.

8.3 The Landlord shall be entitled to carry out such repairs, additions or alterations to the Premises that the Landlord may be required from time to time to carry out by a competent authority, subject to the requirements of reasonableness.

8.4 The Landlord shall be entitled to affix and show on the windows of the Premises or elsewhere thereon "TO LET" or "FOR SALE" notices during the period of two (2) months immediately preceding the termination of the lease.

8.5 The Landlord shall be entitled to show the leased Premises to prospective tenants at all reasonable times after having informed the Tenant of the Landlord's intention of doing so.

8.6 The Landlord shall be entitled to inspect the Premises at all reasonable times after reasonable notice to the Tenant.

9.1 Should the Premises be destroyed or damaged after the commencement date to an extent which prevents the Tenant from having substantial beneficial occupation thereof, then:

• The Tenant shall have no claim of any nature whatsoever against the Landlord as a result thereof.
• Either party, provided that such party is not responsible for the destruction or damage, shall be entitled to terminate the lease within 30 (thirty) days after the destruction or damage, with effect from the date of notification of termination.
• Should the lease be terminated in accordance with the foregoing, the Tenant shall not be liable for rental from the date of termination.
• If destruction or damage is caused by an act or omission for which either party is wholly or partly responsible in terms of this lease or in law, the other party shall not be precluded from exercising or pursuing any right of action or remedy which it may have.
• The provisions of this clause shall apply if damage or destruction is caused by vis major, casus fortuitous or otherwise.
• The Landlord's right to terminate the lease shall be limited to substantial structural damage, whereas the Tenant shall have the right to terminate whenever there is substantial interference with the Tenant's right to full use and enjoyment of the Premises for the purpose for which they were let.

9.2 Should any part, but not the whole, of the Premises be destroyed or damaged but the Premises remain capable of substantial beneficial occupation, then:

• The lease shall not be terminated.
• The rent payable by the Tenant shall be reduced in proportion to the percentage of property damaged until the property has been repaired by the Landlord so as to compensate the Tenant fairly for the effect of the damage.
• The Landlord shall repair the damaged or destroyed portion of the Premises with all due diligence and haste.
